Every online entrepreneur needs to get sales tax compliant before the deadline hits or they could face huge fines, which are more than capable of bringing down a small business.<a href=\"http:\/\/blog.huddlestontaxcpas.com\/wp-content\/uploads\/2016\/01\/EntrepreneurPic.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1407 alignright\" src=\"http:\/\/blog.huddlestontaxcpas.com\/wp-content\/uploads\/2016\/01\/EntrepreneurPic-300x225.jpg\" alt=\"EntrepreneurPic\" width=\"300\" height=\"225\" \/><\/a><\/p>\n<p><strong>The Right State of Mind<\/strong><\/p>\n<p>Bear in mind that this sales tax has nothing to do with the Federal government or the IRS. It\u2019s levied by individual states. You have a duty to collect sales tax in jurisdictions where you have a Nexus, or a significant business presence.<\/p>\n<p><strong>Calculate the Nexus<\/strong><\/p>\n<p>If you have:<\/p>\n<ul>\n<li>An address.<\/li>\n<li>A postal location.<\/li>\n<li>A dropship relationship.<\/li>\n<li>3<sup>rd<\/sup> party affiliates<\/li>\n<li>Temporary business presence<\/li>\n<\/ul>\n<p>Then any of this means you have a Nexus in that state. In other words, you have to collect and declare any sales tax based on the states you have a Nexus in.<\/p>\n<p><strong>Get a Permit<\/strong><\/p>\n<p>You must have a permit to collect sales tax. This is to prevent fraud where businesses claiming sales tax are actually placing the tax into their pockets without passing it on. You must register for a sales tax permit in order to legally collect any sales tax.<\/p>\n<p><strong>Create a System<\/strong><\/p>\n<p>Finally, you have to create a system to collect sales tax. This is not for your sake. It\u2019s designed to show to any inspectors and auditors that you\u2019re doing things by the book.
